Introduction
1. Introduction & agreement
Please read and understand Cuddle's Terms of Use, together with our Privacy Policy and Virtual Goods and Currency Terms of Use. By accessing or using Cuddle's services, you agree to be bound by them.
2. Description of services
Cuddle provides a service that lets users ("Cuddle Account holders") create personal profiles and communicate with other members based on location. The services include our mobile apps (Cuddle and Cuddle+) and website (www.prideparty.app), collectively the "Services."
3. Acknowledgment of agreement
By accessing, downloading, using, purchasing, paying to use, or subscribing to the Services, you acknowledge you've read, understood, and agreed to these Terms. Continued use means continued agreement.

Eligibility
1. Age requirement
You must be 18 or older to create a Cuddle account and use the service. No exceptions — this is a space for adults.
2. Representation and warranty
By creating an account and using the service, you represent and warrant that:
- You can form a binding contract with Cuddle — meaning you have legal capacity to agree.
- You are not prohibited from using the service by U.S. law or any other applicable jurisdiction (e.g., you do not appear on the U.S. Treasury's Specially Designated Nationals list).

Use of the Services
1. Registration
Register and create only one unique account. A "Cuddle Account" can be made with a valid email and phone with a password. Registration may include verification via SMS or a photo with a fixed posture. You'll provide certain information as prompted.
2. Account security
- User responsibility — you are fully responsible for keeping your account confidential and for all activity under it, including paid-service purchases.
- Username selection — you alone choose your username and handle any consequences of sharing it.
- Login credentials — keep your username and password private. Forgot them? Recover via the email on file.
- Unauthorized use — tell us immediately if you suspect unauthorized access or a security breach.
- Reporting breaches — email our support team if you believe your account was accessed by someone else.
- Liability disclaimer — Cuddle isn't liable for losses arising from theft or misuse of your account.
3. Exclusive use
The Services are for your personal use only — no commercial use, no lending your account, no transferring rights. Cuddle may disable or terminate accounts that break this, without notice.
4. Data usage charges
Using Cuddle on mobile may eat into your data plan. Check with your carrier about data charges; Cuddle isn't responsible for them. You're also responsible for any roaming or connectivity fees.
5. User conduct
Be kind. More concretely:
- Don't use the Services in any unlawful way or to harm or violate others' rights.
- No lewd, harassing, obscene, intimidating, threatening, predatory, or stalking behavior — ever.
- Don't use Cuddle in dangerous settings where failure could cause harm (no driving while swiping, please).
- Don't disrupt, damage, disable, overload, or impair the Services or our systems — or interfere with other users.
- No commercial use, and no promoting political platforms, religions, cults, or sects.
- No fraud, no swindling, no deception of other users.
- Don't share others' personal info without permission, or collect it for commercial or unlawful use.
- No gambling or illegal activities.
- No scripts, bots, or scrapers.
- No phishing, trolling, or similar behavior.
When in doubt: would you want this done to you? If no, don't.

User Content
1. Responsibility for your content
- You are solely responsible for any content you provide, publish, transmit, or display on Cuddle.
- This includes messages, data, photos, videos, voice, and anything else you post.
- Cuddle doesn't control or take responsibility for content posted by users or third parties.
- Cuddle isn't liable for mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography, or profanity in user content.
2. Accuracy
- No inaccurate, misleading, incomplete, or false info.
- Photos on your Cuddle profile must be of you. Actually you.
- You may need to provide certain info and a real photo to use the Services.
3. No duty to review
- Cuddle isn't obligated to prescreen, review, control, monitor, or edit user content.
- We reserve the right to review, edit, refuse, or delete content at our discretion, without notice, for any reason or no reason.
- Back up anything important — you're responsible for replacing lost content at your own cost.
- We may modify or crop photos to comply with our policies and practices.

Use of proprietary information of others
- Don't post, copy, transfer, create derivatives of, distribute, reproduce, or display copyrighted, trademarked, or proprietary material without the owner's prior consent.
- This applies whether or not the material is explicitly labeled as protected — assume it may be.
- This prohibition extends to user content posted by other members.
- Information or materials available through the Services may be protected by copyright, whether or not that's flagged.

Prohibited content
Cuddle is a warm space. Keep it that way. Don't post content that is:
- Obscene, pornographic, profane, defamatory, abusive, offensive, indecent, sexually oriented, lewd, threatening, harassing, inflammatory, inaccurate, misrepresentative, fraudulent, or illegal.
- Promoting racism, sexism, homophobia, bigotry, hatred, or physical harm against any group or individual.
- Intended to harass or intimidate any user or third party.
- Infringing any patent, trademark, trade secret, copyright, or other IP of any party.
- Containing video, audio, photos, or images of another person without their express written consent — or violating anyone's right of privacy or publicity.
- Promoting or enabling illegal or unlawful activities (e.g., how to make or buy illegal weapons or drugs).
- Violating someone's data-privacy or data-protection rights.
- Containing viruses, time bombs, malware, trojan horses, cancelbots, worms, or similar harmful code.
- Advertising, fundraising, or promotional content.
- Anything Cuddle judges, in its sole discretion, to be objectionable or harmful to users or Cuddle.
These guidelines exist to keep everyone feeling safe, respected, and free to be themselves. Violations may result in content removal, account suspension, or termination.

Third-party content
1. Third-party content
Cuddle may link to or include third-party web pages, applications, mobile apps, and sites.
2. No control or endorsement
We don't control, endorse, or adopt third-party content. We expressly disclaim responsibility for its accuracy or completeness.
3. Disclaimers
No representations, warranties, or conditions from us regarding third-party content. You use it at your own risk.
4. No responsibility to update
We aren't obligated to update or review any third-party content.
In short: we don't endorse or take responsibility for accuracy or quality of third-party content — handle with care.

Paid services
1. Automatic renewal of subscriptions
- Continued subscription — if you don't cancel before the term ends, it will auto-renew indefinitely until you cancel.
- Price & duration — after the initial period, your subscription renews at the same price for an equivalent period.
- Consent to auto-renewal — by using the service and agreeing to these terms, you consent to automatic renewal and charges (including taxes) to your third-party account.
- Responsibility for charges — you accept responsibility for recurring charges without further authorization, except as required by law.
2. Cancellation of subscriptions
- How to cancel — through the third party where you made the initial purchase (e.g., App Store), per their terms.
- Effective date — cancellation kicks in at the start of the next billing period.
- Continued benefits — you keep subscription benefits through the current term; it just won't renew.
- No refunds — no prorated refund for the current term upon cancellation.

Modification
We may change, modify, add, or remove parts of these terms and related policies at any time, at our sole discretion. Changes become effective immediately upon posting. Continuing to use the Services means you accept the revised terms. Please check in from time to time — the top of the Terms will always show a "last updated" date.

Miscellaneous
Cuddle has taken reasonable steps to ensure the currency, availability, correctness, and completeness of the information on the Service, provided on an "as is" and "as available" basis. We don't make any express or implied warranty about the information on the Service. Use of the Service and its materials is at your sole risk. Cuddle cannot be held responsible for losses from transmission, data use, or inaccurate content posted by users. You're responsible for taking all necessary precautions — including ensuring materials are free of viruses. You accept that the Service may not be uninterrupted or error-free, defects may not be corrected, and the Service or its server may not be free of bugs, spyware, trojans, or similar. Cuddle isn't responsible for damage to your hardware, software, or equipment — including from security breaches, viruses, tampering, fraud, errors, omissions, interruptions, defects, delays, network failures, or other malfunctions.
We reserve the right to modify the Terms at any time ("Change"). Changes will be posted here, with the effective date at the bottom. In some cases, we may email you to notify you of a Change. Please check this page regularly. Continued use of the Service after a Change constitutes acceptance of the new Terms. If you don't accept a Change, stop using the Service and delete your account.

Terminating
You may deactivate or delete your account at any time: go to Settings and tap Delete account.
If you choose to leave the Service rather than deactivate, clicking "Delete account" removes your account permanently with no option to restore. Your data and profile content will be kept on our servers only for the safety period required by law.
Cuddle reserves the right, at its sole discretion and without prior notice, to suspend or delete your account. In that case you won't be entitled to a refund of unused fees for in-app purchases.
